InitialChat's Terms of Service define the legal agreement between users and our AI platform. Key provisions include a strict Fair Use Policy to prevent AI abuse, a standard No Refund Policy due to immediate resource consumption (AI credits and compute), and limitations of liability to ensure sustainable service delivery for all customers.
1. How Do I Agree to InitialChat's Terms?
By accessing or using InitialChat, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service. These terms apply to all visitors, users, and others who access or use the Service.
2. What is InitialChat's Fair Use & AI Abuse Policy?
To ensure the quality and availability of our service for all users, we enforce a strict Fair Use Policy regarding our AI Agents and Chatbots. Prohibited activities include, but are not limited to:
- Automated Abuse: Using automated systems to send excessive requests to AI agents beyond reasonable human interaction levels.
- Deceptive Content: Configuring AI agents to generate misleading, fraudulent, or harmful content.
- Reverse Engineering: Attempting to reverse engineer or extract the underlying models or logic of our AI systems.
- Scraping: Using AI agents to scrape data from third-party websites in violation of their terms.
InitialChat reserves the right to suspend or terminate accounts that demonstrate patterns of AI abuse or violate this Fair Use Policy without prior notice.
3. What is InitialChat's Refund Policy?
InitialChat operates on a usage-based resource model. Because AI credits, compute power, and LLM (Large Language Model) resources are consumed immediately upon use, we maintain a strict no-refund policy.
- Subscription fees and credit purchases are non-refundable.
- Unused credits do not have a cash value and cannot be refunded.
- In the event of account termination due to policy violations, no refunds will be issued for remaining balances.
4. What are InitialChat's Limitations of Liability?
InitialChat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
